Termeni și Condiții — EVENTS Gateway

Termenii care guvernează utilizarea serviciilor noastre de integrare Facebook.

1) Acceptare

Folosind EVENTS Gateway ("Serviciul"), ești de acord cu acești Termeni și Politica noastră de Confidențialitate. Dacă folosești Autentificare Facebook sau conectezi un cont Meta, ești de acord și cu termenii și politicile aplicabile Meta referite mai jos. Minorii nu pot folosi Serviciul dacă legea lor locală o interzice.

2) Conturi și Autentificare Facebook

• Poți să te autentifici prin Autentificare Facebook. Primim datele la care consimți să le partajezi (ex. nume, email, ID profil) și orice permisiuni viitoare pe care le aprobi în aplicație.
• Trebuie să menții securitatea contului tău și ești responsabil pentru toată activitatea sub el.
• Poți deconecta Autentificarea Facebook oricând în setările Facebook; procesul nostru de ștergere date este în §7.

3) Permisiuni și Scopuri

• Putem solicita permisiuni suplimentare (ex. gestionare reclame, citire reclame, gestionare afaceri) doar pentru a furniza funcții pe care le alegi (creare campanii, raportare, optimizare).
• Poți refuza sau revoca permisiunile; funcțiile afectate pot înceta să funcționeze.

4) Utilizare Marketing API și Business Tools

• Dacă conectezi un cont publicitar, Pagină, Business Manager, pixel, conversions API, audiențe, cataloage sau alte Business Tools, procesăm și transmitem acele date către Meta pentru a efectua publicitatea, măsurarea și raportarea pe care le soliciți.
• Utilizarea ta trebuie să fie conformă cu Termenii Platformei Meta, Politicile Dezvoltatorilor, Termenii Business Tools, documentația Marketing API, Standardele de Publicitate și orice Termeni Audiențe Personalizate dacă sunt aplicabile. Putem suspenda Serviciul unde utilizarea ta pare neconformă.

5) Responsabilitățile Tale

• Furnizează informații precise; ai autoritatea și baza legală pentru a procesa orice date pe care le încarci sau sincronizezi (incluzând liste de clienți).
• Nu folosi Serviciul pentru a discrimina, înșela, încălca, trimite spam sau viola legea, regulile platformei sau drepturile terților.
• Nu trebuie să încerci să ocolești revizuirea Meta, limitele de rată sau aplicarea.

6) Utilizarea Noastră a Datelor de la Meta

• Folosim datele Meta doar pentru a livra funcțiile Serviciului pe care le selectezi (ex. gestionare campanii, insight-uri, optimizare, construire audiență, reconciliere facturare, alerte anomalii).
• Nu vindem datele derivate din Meta și nu le transferăm către terți cu excepția (i) furnizorilor de servicii sub contract și confidențialitate; (ii) conform cerințelor legii; sau (iii) la direcția ta.
• Agregăm și anonimizăm datele pentru analiză și îmbunătățirea produsului.

7) Retenție și Ștergere

Reținem datele sursa Meta doar atât timp cât este necesar pentru Serviciu, audituri sau obligații legale, după care le ștergem sau anonimizăm.

Ștergere inițiată de utilizator:

Deconectează EVENTS Gateway în Facebook > Setări > Aplicații și Site-uri Web; și

Trimite o cerere de ștergere prin pagina publică de contact sau folosește portalul de ștergere date, dacă este disponibil.

Callback Ștergere Date Facebook: Când Meta apelează callback-ul nostru la eliminarea aplicației sau eliminarea accesului la date, ștergem datele Facebook asociate legate de contul tău.

8) Audiențe Personalizate (dacă sunt folosite)

• Vei încărca sau sincroniza doar liste de clienți unde ai toate drepturile necesare și baza legală validă.
• Vei onora divulgările Meta și notificările necesare și vei accepta orice termeni în produs.
• Nu vei combina sau re-identifica raportarea Meta pentru a afla identități individuale.

9) Conduită Interzisă

Nu poți:

• abuza de token-uri de acces, token-uri utilizator sistem sau credențiale
• extrage sau cache date în afara retenției permise
• folosi date pentru a construi profiluri independente de scopurile permise Meta
• direcționa sau exclude utilizatori pe baza trăsăturilor sensibile unde este interzis
• partaja date cu brokeri
• folosi pentru a exploata minori
• inginerie inversă API-uri non-publice

10) Proprietate Intelectuală

Noi (și licențiatorii noștri) deținem Serviciul. Tu deții conținutul tău și ne acorzi o licență non-exclusivă pentru a opera Serviciul. Conținutul Meta este supus termenilor și drepturilor Meta.

11) Servicii Terțe

Meta/Instagram/Facebook și alte servicii terțe nu sunt furnizate de noi. Termenii lor guvernează utilizarea ta a acelor servicii. Nu suntem responsabili pentru întreruperi, schimbări sau acțiuni de aplicare de către terți.

12) Declinări Responsabilitate și Limitare Răspundere

Serviciul este furnizat "ca atare". În măsura maximă permisă de lege, declinăm garanțiile și limităm răspunderea pentru daune indirecte sau consecvente. Răspunderea noastră agregată nu va depăși sumele pe care le-ai plătit în ultimele 12 luni.

13) Indemnizație

Ne vei indemniza și proteja de revendicări care decurg din utilizarea ta a Serviciului, datele tale sau încălcarea acestor Termeni sau a regulilor platformei aplicabile.

14) Suspendare și Încetare

Putem suspenda sau înceta accesul pentru abuz suspect, risc legal sau neconformare platformă. Poți înceta să folosești Serviciul oricând. Secțiunile care prin natură ar trebui să supraviețuiască (ex. §§6-9, 12-15) vor supraviețui încetării.

15) Modificări

Putem actualiza acești Termeni și vom posta data intrării în vigoare. Utilizarea continuă după modificări înseamnă acceptare. Dacă nu ești de acord, încetează să folosești Serviciul.

16) Legea Aplicabilă și Dispute

Acești Termeni sunt guvernați de legile statului Delaware, Statele Unite. Revendicările vor fi soluționate exclusiv în instanțele din Delaware, cu excepția cazului în care legea obligatorie prevede altfel. Tu și noi renunțăm la acțiuni colective în măsura permisă.

1. Acceptance of Terms

By accessing and using EVENTS Gateway ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User" or "you") and EVENTS Gateway ("we," "us," or "our"). By creating an account, accessing our platform, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Description of Services

EVENTS Gateway provides advanced event tracking, analytics, and business intelligence services including but not limited to:

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice, though we will make reasonable efforts to notify users of significant changes.

• Core Analytics: Real-time event tracking across multiple platforms
• Core Analytics: Advanced conversion funnel analysis
• Core Analytics: Customer journey mapping and attribution
• Core Analytics: Revenue tracking and ROI measurement
• Core Analytics: Custom event definition and monitoring
• Enterprise Features: Interactive dashboards and visualizations
• Enterprise Features: Automated report generation and scheduling
• Enterprise Features: API integration with third-party platforms
• Enterprise Features: White-label solutions and custom branding
• Enterprise Features: Dedicated support and account management

3. User Accounts and Registration

To access certain features of EVENTS Gateway, you must register for an account. When registering, you agree to:

You are responsible for safeguarding your account credentials and for all activities that occur under your account. We cannot and will not be liable for any loss or damage arising from your failure to comply with this security obligation.

• Provide accurate, current, and complete information about yourself as prompted by the registration form
• Maintain and promptly update your account information to keep it accurate, current, and complete
• Maintain the security of your password and accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access to or use of your account
• Be at least 18 years old or have legal capacity to enter into contracts
• Have authority to bind your organization to these terms if acting on behalf of a business

4. Acceptable Use Policy

You agree to use EVENTS Gateway only for lawful purposes and in accordance with these Terms. You agree NOT to use the Service:

Violation of this Acceptable Use Policy may result in immediate termination of your account and access to the Service.

• Prohibited Activities: To violate any applicable local, state, national, or international law
• Prohibited Activities: To collect, track, or harvest personally identifiable information without proper consent
• Prohibited Activities: To attempt to gain unauthorized access to our systems, servers, or networks
• Prohibited Activities: To interfere with or disrupt the Service or servers connected to the Service
• Prohibited Activities: To transmit any malicious code, viruses, or harmful components
• Prohibited Activities: To engage in any activity that could damage, disable, overburden, or impair the Service
• Compliance Requirements: GDPR compliance for EU data subjects
• Compliance Requirements: CCPA compliance for California residents
• Compliance Requirements: HIPAA compliance for healthcare data (where applicable)
• Compliance Requirements: PCI DSS compliance for payment data
• Compliance Requirements: Industry-specific regulations as applicable
• Compliance Requirements: Proper user consent and privacy notices

5. Data Handling and Privacy

Your privacy and data security are paramount to us. Our data handling practices include:

• Data Ownership: No ownership claims on your business data
• Data Ownership: Right to export data at any time
• Security Measures: Industry-standard encryption and security

6. Billing, Payments, and Refunds

EVENTS Gateway offers various subscription plans and pricing models:

• Subscription Terms: Monthly and annual subscription options with different feature sets
• Subscription Terms: Payments are due in advance and are processed automatically
• Subscription Terms: Subscriptions automatically renew unless cancelled before renewal date
• Subscription Terms: We may modify pricing with 30 days' notice to existing subscribers
• Subscription Terms: Failure to pay may result in service suspension or termination
• Subscription Terms: All fees are exclusive of applicable taxes, which you are responsible for paying
• Refund Policy: 30-day money-back guarantee for new subscribers who are not satisfied
• Refund Policy: Pro-rated refunds for service outages exceeding our SLA commitments
• Refund Policy: Setup fees are non-refundable after service has been activated
• Refund Policy: Refund requests must be submitted within 30 days of the qualifying event
• Refund Policy: Processing time for approved refunds is 5-10 business days

7. Intellectual Property Rights

EVENTS Gateway and its licensors own all intellectual property rights in the Service, including:

• Our Property: Software, algorithms, and proprietary technology
• Our Property: User interface designs, graphics, and visual elements
• Our Property: Documentation, guides, and educational materials
• Our Property: Trademarks, service marks, and trade names
• Your License: Limited, non-exclusive, non-transferable license
• Your License: Valid only during your subscription period
• Your License: No ownership rights or sublicensing permitted
• Your License: Cannot create derivative works of our platform

8. Limitation of Liability and Disclaimers

To the maximum extent permitted by law:

• Service Warranties: 99.9% uptime availability guarantee (excluding planned maintenance)
• Service Warranties: Services will perform substantially as described in documentation
• Service Warranties: Data processing accuracy within industry-standard tolerances
• Service Warranties: Security measures meet or exceed industry best practices
• Liability Limitations: Our total liability shall not exceed the amount you paid in the 12 months preceding the claim
• Liability Limitations: We shall not be liable for indirect, incidental, special, consequential, or punitive damages
• Liability Limitations: We disclaim all warranties including merchantability and fitness for a particular purpose
• Liability Limitations: Force majeure events (natural disasters, government actions) exclude liability

9. Termination and Account Closure

Either party may terminate this agreement under the following conditions:

• Termination by You: Cancel anytime with 30 days notice
• Termination by You: Access continues until end of billing period
• Termination by You: Data export available for 90 days post-cancellation
• Termination by You: No refund for partial month usage
• Termination by Us: Violation of these Terms of Service
• Termination by Us: Non-payment after grace period
• Termination by Us: Fraudulent or illegal activity
• Termination by Us: Abuse of our systems or support staff

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising under these Terms shall be resolved through the following process:

1. Direct Communication: Attempt to resolve disputes through direct communication with our legal team

2. Mediation: If direct communication fails, disputes will be submitted to mediation

3. Arbitration: Unresolved disputes will be settled through binding arbitration

4. Jurisdiction: Any legal proceedings will be conducted in the appropriate jurisdiction

11. Changes to Terms

We may revise these Terms at any time by posting updated Terms on our website. We will notify you of material changes through:

In-app notifications when you next log in

Prominent notices on our website and platform

30 days advance notice for material changes

Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
